Commitment to Purchase and Deposit
If you find that perfect friend and you want us to hold him/her, we ask you to send a $200 deposit that is not
refundable. A non-refundable deposit is required to hold a dog/puppy. It will not be refunded if you change your mind
for ANY reason.. Additionally money deposited on the dog/puppy will not be transferred to a different litter unless the
breeder is supplied with an acceptable reason for delaying your purchase. The funds paid on the dog/puppy is
forfeited to the Breeder should you not supply an acceptable explanation. If for ANY reason the Buyer does not
complete the purchase before the puppy is 7-9 weeks of age, all money placed on the puppy will not be refunded or
transferred to a different litter or any puppy in that litter and any funds paid on the puppy is then forfeited to the
Breeder. Furthermore if the Breeder has not heard from you at all for 30 days or 7 days prior to the puppy/dog being
ready for it's new home (7-9weeks old for a puppy or 14 days after an adult has been neutered) than the Buyer will
forfeit the deposit as well as any and all additional money placed towards said puppy/dog.

Shipping also needs to be paid in full before the puppy is 7 weeks of age so shipping arrangements can be made. Cost
of Shipping is separate from the cost of the dog/puppy. Breeder will not hold a puppy if shipping is not paid in full by 7
weeks of age. If it is not paid in full, no money will be refunded and all funds paid on this puppy will then be forfeited to
the Breeder. Current Shipping Cost averages around $375. We will not use the cheaper airline carriers who do
not take as good a care of the puppies...You do get what you pay for.
Housing your dog/puppy until you are ready for them.(if applicable)
If it is necessary for the Breeder to house your dog/puppy past 9 weeks of age it is agreed that a mutually agreed upon
fee will be paid before possession of dog/puppy takes place. This fee will not exceed $30 a week except when
additional services are necessary such as booster vaccinations or other requested services. Should Housing be
requested an additional contract will be supplied that details the time length of Housing, arrangements for delivery, any
additional services requested and it is required that the new owner sign and return said contract along with payment in
full to cover the Housing Fee and any requested additional services. Additionally if the dog is an adult that has been
neutered before being placed in your home the 14 day recovery period is included in the adoption fee. Time after the
surgery recovery period of 14 days will not exceed $30 a week except when additional services are necessary or
requested by the buyer.
Naming your puppy.
All puppies names will begin with Kattery's or if the dog has a Merle ancestor Kattery’z
and then the name that you provide.
(For example Kattery’s Sunshine for a buff dog or Kattery’z Splash for a merle dog)
All AKC papers will have Kattery's/z on them when they are provided for you.
The Buyer agrees that he/she will not alter Kattery's/z on the papers.
Breeder requires for her records (and the AKC asks for this as well) you let her know the name of your puppy once you
have decided on it or registered it.
Health Records:
Dew claws are removed and tails docked @ 3 days of age.
Vaccinations given by Breeder on a schedule recommended by our Veterinarian.
Proper vaccinations for dog/puppy's age are given.
Worming is provided on a schedule recommended by our Veterinarian.
Should pest control be needed it will be supplied during the dog/puppy's stay with the Breeder and every possible
condition will be made to allow the dog/puppy to arrive at it's new home without pests.
A copy of health records for your dog/puppy will be given at the time of delivery.
Please keep a copy of this for your records and for the vet.
1 Year Congenital Health Guarantee:
To the best of the Breeder's knowledge the puppy is in good health at the time of sale. Your puppy is guaranteed for
one (1) year from date of purchase by Breeder against any non treatable congenital defect. The exceptions are cherry
eye, which is considered to be a breed defect, submissive wetting, food allergies and/or behavioral problems. It is the
responsibility of the buyer to train and socialize the puppy.
If the puppy is examined by a licensed veterinarian and found to have a non treatable congenital defect condition, the
seller shall replace the dog, with the next available puppy of the same sex, color and like pedigree. In some cases a
refund may be provided.
A copy of the vet report (including the veterinarian's contact information (Address & telephone number) must be given to
the seller at the time of notification. In the event of death, an autopsy report shall be performed at buyer's expense to
determine the congenital defect and cause of death. The report must be provided before a replacement pup is given.
The breeder is not responsible for any vet charges or fees in diagnosing or treating any illness or genetic defect or any
other health concerns unless authorized in writing prior to receiving them.
There will be no replacement pup given if the death was the result of abuse, neglect or accident. If the puppy is
euthanized before the Breeder has consented to euthanasia or been informed of the congenital defect this agreement is
deemed voided by the Buyer and no replacement puppy or refund will be provided.
Guarantee is extended to the ORIGINAL purchaser listed on this contract agreement not to anyone else. Should the
puppy be resold or ownership transferred to anyone else this guarantee is NOT extended. We do not sell to brokers or
people in the business of re-selling dogs.
Buyer Requirements:
Have a physical examination completed by your local Veterinarian within 72 hours of arrival.
Give all immunizations, as recommended by Veterinarians.
Register or license the dog as per your local city and state codes.
If illness or injury occurs, dog/puppy is to receive immediate veterinary care.
The Breeder is not responsible for any charges for Veterinarian care for treatment of illness, or determination of illness
or genetic disease once the puppy leaves the Breeder’s possession.
Additional Agreements:
If at any time the Buyer finds themselves unable to keep and care properly for the dog/puppy the Breeder agrees to
take back the dog/puppy and re-home it. Buyer must disclose any health or behavioral issues (if any) at that time and is
responsible for delivering dog/puppy to Breeder. If at any time the Buyer re-homes the dog/puppy for any reason Buyer
agrees to notify Breeder in writing of the new owners names and address and inform the new owners of how to contact
the Breeder. ANY of our Dogs/Puppies are ALWAYS welcome to be returned to us for any reason and we will either
keep them or re-home them in a suitable environment. It is however up to the Buyer to contact us and make travel
arrangements. Once dog/puppy is returned to us Buyer relinquishes any rights present or future to said animal.
BILL OF SALE
1. The puppy is defined to be an American Cocker Spaniel puppy, and embodies characteristics of the American Cocker
Spaniel Breed. The puppy is able to be registered with the American Kennel Club (AKC). Breeder hereby covenants
with Buyer that Breeder is the owner of the said personal property, that Breeder has good and lawful authority to sell,
transfer, and assign the same and the same is free and clear of all liens, security interests and encumbrances except as
may be above stated. According to the Procedure code through the AKC, Breeders do have up to 6 months to supply a
Dog Registration Application or otherwise known as AKC Papers on the said dog. The breeder agrees that the AKC
papers that were granted will be given to you in that time frame. Usually the papers go with the puppy, if not, a short
while afterwards. Delay is normally a result of the registry process with the AKC. There does seem to be a little longer
of a wait during holidays as a lot of litters are planned during that time.
2. Breeder hereby sells and transfers Breeder;;s interest in the puppy in AS IS condition. All expressed/implied
warranties other than the 1 year congenital health defect guarantee are excluded. There are no additional warranties
extended.
3. The Breeder does not assume any liability for injury to the said puppy after the date of shipping or when puppy is in
the possession of purchaser.
4. Any and all veterinarian care and expenses for this puppy are sole responsibility of the Buyer, as Breeder has no
control over the puppy‘s new environment, exposure, food in take, veterinarian care and socialization once it leaves
Breeder’s home and Breeder‘s possession. The Breeder is not responsible for any charges incurred once the puppy
leaves Breeder’s possession.
5. If you are planning on buying a puppy for the purpose of showing we do not guarantee your puppy will win or place in
any competition/event or finish with any title. As there are a multitude of variables.
6. If shipping is required, the Breeder is not responsible if the puppy is injured, lost, stolen, killed, or occurs health
problems.
7. The maximum the Buyer is able to sue the Breeder for is 10% of the purchase price.
8.. The Breeder is not responsible for any charges incurred nor replacement of the puppy beyond the one year
congenital health defect guarantee.
9. Buyer agrees the puppy is sold AS IS. Buyer further recognizes Breeder makes no warranties regarding the condition
of the puppy, including but not limited to if this puppy will produce and what color he/she will produce. Furthermore it is
agreed that unless otherwise specified above the dog/puppy will not be bred and it is recommended by the Breeder to
have the dog/puppy surgically sterilized at the appropriate age.
10. All dogs are sold as companion animals. They are not sold as Breeding prospects. If you choose to breed that is
totally your choice as some dogs are sold on Full Registrations so you can have the choice at a later date. There is no
warranty given as to it's fitness for breeding, show ability, etc. In order to encourage responsible pet ownership
KatteryKennels will refund $50 to a puppy Buyer once they spay or neuter their pet if they do so before the pet has
been bred and or one year of age. A veterinary spay/neuter certificate must be sent to us and we will verify that the
sterilization has been performed by your vet. We will send you a check in the amount of $50 within 30 days of receipt of
the spay/neuter certificate. We will not issue a refund if the pet has been bred at any time and offspring produced.

The provisions of this Agreement shall be interpreted and constructed in accordance with laws and statues of the State
of Kansas. The venue of any litigation concerning the Agreement shall be in Linn Country, Kansas.

After you have selected a dog/puppy to purchase from us and discussed either by email or telephone with us
(make sure the dog/puppy is available and that you qualify thru our screening process to own one of our dogs)
you will be given an address that you need to mail a signed copy of this contract, along with your deposit
payment, to. We do this to protect our privacy as individuals
Deposits are non refundable and a "HOLD" will be placed on the
dog/puppy for 5 days only so please make appropriate plans for
mailing arrivals. (in some cases a faxed copy of the contract and a wire
transfer of funds may be advisable)
